Child's welfare prevails over unproven allegations, mother gets custody, J&K High Court
The Jammu and Kashmir and Ladakh High Court has restored the interim custody of a 6 year old girl to her mother, holding that the child's welfare must remain the paramount consideration and cannot be overshadowed by unproven allegations exchanged between the parents.
The case arose from a custody dispute following matrimonial discord between the couple. The mother alleged that the father had forcibly taken the child from her custody, after which the Child Welfare Committee restored the girl to her care. However, a trial court later granted interim custody to the father, observing that the mother had prima facie abused the legal process by filing a marital r@pe complaint.
Challenging that order, the mother argued that the trial court had wrongly relied on allegations that were still under investigation while ignoring the welfare of the child. She also pointed out that the Child Welfare Committee had restored custody to her after interacting with the child and finding her comfortable and happy in her mother's care.
The High Court observed that custody proceedings are not meant to determine the truth of matrimonial allegations but to secure the best interests of the child. It held that the trial court had erred by allowing itself to be influenced by the pending criminal case instead of focusing on the child's welfare.
After interacting with the 6 year old, the Court found her to be intelligent, cheerful and emotionally comfortable. It observed that at such a young age, continuity of care, emotional stability, educational consistency and a nurturing environment are of greater importance than unresolved allegations between the parents.
Accordingly, the High Court set aside the trial court's order, restored the child's interim custody to the mother, and directed that the father be granted visitation and interim access as determined by the trial court.
